How to respond when your ex threatens custody by text

Stay calm, stay factual and protect your position when custody becomes a weapon in an argument.

The situation

A disagreement about something small, like a late pickup or a missed call, suddenly turns into "maybe we need to look at custody again." It's frightening, and that's usually the point. Threats like this are often about leverage in the moment, not a real plan.

What's really going on

The other parent is usually anxious or angry about something specific and is reaching for the biggest lever they have. If you react to the threat, the conversation becomes about custody. If you answer the underlying issue calmly, there's often nothing left to fight about.

Example replies

They write: "If you can't manage a simple pickup time, maybe the judge should decide how much time you get."

  • Peacekeeper: "I can see the pickup timing has been frustrating. I want handovers to be easy for the kids too. From now on I'll collect them at 5:00 pm on Fridays."
  • Barrister (record-ready): "To confirm: I will collect the children at 5:00 pm each Friday, starting [date]. If you would like to change the arrangement, please put it in writing."
  • Grey rock: "Noted. 5:00 pm on Fridays."
  • Assertive: "I'm happy to agree to 5:00 pm on Fridays. I won't discuss custody by text. If you want to change the arrangement, please raise it through [our mediator / your solicitor]."

What not to do

  • Don't threaten back.
  • Don't argue about who is the better parent.
  • Don't admit to things you didn't do just to calm things down.
  • Don't ignore genuine practical issues. Fixing the pickup time removes the excuse.

Keep a record

Save the messages and note dates and times. If threats continue, share the record with a family lawyer. This guide is not legal advice; custody rules vary by country and state.
